These terms and Conditions mentioned in this Agreement offers you with limited privilege to enter this website and access to non-exclusive, non-transferable personal account.   These Terms and conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

www.bhu.co.in (BHUH) reserves the right to revise, change, modify, remove certain parts of the Terms and Conditions mentioned in this Agreement at any point of time notifying its users through mails and by posting in the website. The revisions, changes, modifications, removal made in the Terms and Conditions Agreement will be effective as soon as it is posted in the website. Your continued use of our website confirms your agreement to this revised, changed, modified, removed Terms and Conditions. Hence it is advisable to review this Agreement whenever you use this Website. If you don’t agree to the Terms and Conditions stated in this Agreement or disagree to any policies and guidelines stated by us in this Agreement you are requested to terminate the use of our Website immediately.

 Characterizations Throughout the site, the terms “we”, “us” and “our” refers to the company or bhuh.co.in (BHUH). The terms “you” or “user” refers to the member of the website who registers with urbanbackyards.co.in and provides his / her data using any digital input system. “Products” means the goods sold by the seller in this website.  “Buyer” means the person who buys goods from the Seller. “Seller” means bhu.co.in. (BHUH) “Terms and Conditions” means the conditions applied for sales mentioned in this Agreement.

General Conditions

Eligibility of Use

Access and use of our website “services” and tools are explicitly meant for anyone 18 years of age and above. www.bhu.co.in (BHUH) reserves the right to terminate membership and refuse access to any user found to be a minor or undischarged bankrupts etc. This website is accessible to only those who enter into legal contract with us under the Indian Contract Act, 1872. 

Legal Bindings

This Agreement covers all Terms and Conditions between you and www.bhu.co.in. (BHUH). By using the services and ordering products from this website you agree to be bound by all the Terms and Conditions, mentioned in this Agreement.

Legal Jurisdiction

All the terms and conditions mentioned in this agreement is governed by the laws of India and all disputes / discrepancies are subjected to be heard or preceded under the  Kolkata jurisdiction only.

Indemnification

You agree to indemnify, defend and hold harmless www.bhuh.co.in (BHUH) and any of our parent, subsidiaries, shareholders,  affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees   from any  demand, liabilities, claims , damages , costs and expenses including reasonable attorneys’ fees and expenses , made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

Force Majeure

Under any unusual circumstances or events which is reasonably beyond any control like act of God (earthquake, storm, fire, flood, any other natural disaster), accidents, strikes, lockouts, war, armed conflicts, terrorism, breakdown of plant and machinery, shortage or availability of raw materials from its prime source of supply, neither of the parities will be held responsible for delay in the delivery and that www.bhuh.co.in (BHUH) is entitled for the extension of delivery of the products.

Termination of Contract

In case you breach any of the Terms and Conditions mentioned here in this Agreement, bhuh.co.in (BHUH) reserves the right to terminate your access to our website and cancel any outstanding orders without notifying you.

Process Termination

www.bhuh.co.in (BHUH) at any point of time and without any prior notice on its sole discretion, reserves the rights to cease its services and sales of products.

Limitations of Liabilities

Any new features or tools which are added to the current store shall also be subjected to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page.

1. The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian to make any purchase from us and at the same time we do not hold any responsibility towards any misuse of the product purchased by you (The User).

2. We at BHUH have made every possible effort to display the colour of our products that appear on the site as accurately as possible. However, as the actual colours you see will depend on your monitor so we cannot guarantee that your monitor’s display of colour will be accurate. Also at times due to reflection of light effects it may vary a little which is beyond our control and we shall not entertain any such claims regarding exchanging of products.

3. At BHUH every product is handcrafted, hence there might be minor changes / dissimilarities between products listed under the same stock keeping unit code and product name.

4. BHUH will take “Full Responsibility” * of your Order. This means that we at BHUH ensure you that all the goods will be packed and dispatched in perfect “GOOD CONDITION” and to ensure smooth delivery to your door step we will use all best courier services. The term “Full Responsibility” means packing the goods in perfect conditions at the time goods leaving the warehouse and also we do take utmost care in packing the goods as per their sizes, weight, volume etc. so you need not worry about our highly efficient packaging system.

5. The prices and availability of products are subject to change without prior notice at the sole discretion of BHUH so no disputes shall be entertained.

6. Request for cancellations of orders once placed on bhuh.co.in shall not be entertained. If at all we have to accept any cancellation, there would be a charge of 10% of total amount (excluding shipping amount) of the order as restocking fees. However, after placing an order, customer can only cancel the order if the order state is showing as “pending” under Order History. Cancellations have to be made within (maximum) 2 Hours of placing an order. For cancelling your order, you will have to get in touch with our Customer Support Team by sending an email giving your Order Number.

7. Once the order is placed at bhuh.co.in  no changes can be made in order thereafter.

8. BHUH reserves all right to refuse or cancel any order placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment been received. The payment shall be refunded and the User shall be informed of the same.

9. If a non-delivery or late delivery occurs due to a mistake by the User (i.e. wrong or incomplete name or address or recipient not available) any extra cost spent by BHUH for re-delivery shall be claimed from the User before re-dispatch of the order.

10. By placing the order The User agrees to give accurate, authentic and true information. BHUH reserves the right to confirm and validate the information and other details provided by the User at any point of time. If any such User details are found not to be true wholly or partly BHUH has the right in its sole discretion to reject the registration and debar the User from using the services of bhuh.co.inwithout prior intimation whatsoever.

11. BHUH will not be liable for any type or kind of credit card fraud. The liability to use a card fraudulently will be on the user and the onus to ‘prove otherwise’ shall be exclusively on the user. The User must exclusively use his/her own card on the site at the time of purchase.

12. BHUH provides no warranty, either express or implied with respect to any product, and specifically disclaims all other warranties, including, without limitation, warranties for merchantability, non-infringement and fitness for any particular purpose.

13. BHUH we do take care of complaints related to delivered parcels only if informed within 48 hours of delivery. No complaints shall be entertained regarding the wrongly ordered product by you (The User). This is done in the interest of the consumer to avoid any fake complaints and products.

14. All of the written, photographic and design content of the web site along with the selection and arrangement of it and all software compilations are our copyrighted property or that of the people who have granted to us the right to use it and is protected as such. All rights reserved.

15. No part of this web site may be reproduced, mechanically, electronically, including photocopying, or by any means whatsoever without prior written permission of the company or that of the copyright holder.

16. All names, logos, slogans, or other phrases may be a trade mark of ours or another person or corporation. Any unauthorized use of a trade mark is unlawful.

17. You will not, and you will not assist or facilitate any third party to, copy, reproduce, transmit, distribute, frame, commercially exploit or create derivative works of such material or content. If you become aware of any such distribution or commercial exploitation, you agree to notify us immediately.

18. You acknowledge that by posting materials on the company site you grant to us and our licensors and assigns an irrevocable, perpetual, royalty free, worldwide license to use the materials both within the company site and in any other manner. The license extends to copying, distributing, broadcasting, and otherwise transmitting, and adapting and editing the materials.
